Plaintiff, Vincent March ("Plaintiff" or "March") brings this action against the Defendant, Metro-North Railroad Company ("Defendant" or "MTA"), for violations of the Federal Rail Safety Act ("FRSA"), 49 U.S.C. § 20109. Plaintiff claims that he suffered retaliation, in violation of FRSA § 20109(d)(3), when he was removed from service for "insubordination" after reporting a defective wiper blade on one of the trains.
