This case was submitted to the chancery court on an agreed statement of facts, substantially as follows:
In 1882 the Southwestern Improvement Association, being the owner of a certain tract of land, platted same into lots- and blocks, streets and alleys, as the town of Fordyce. The plat thereof was probably filed with the recorder of Dallas County, but, not being acknowledged, was not placed of record, and no bill of assurance or deed of conveyance of streets and alleys was made to the town.
