CHESNUT, District Judge.
The defendant’s motion to dismiss the complaint in this case raises a question of venue jurisdiction. The complaint, based on section 63 of Title 35, U.S. C.A., seeks to obtain a patent by an equity proceeding, after final rejection- of the patent claim in the United States Patent Office.
