The matter came before the Court on the motion of creditor Cheryl Heins for relief from the automatic stay pursuant to 11 U.S.C. § 362(d)(1). 1 Both Heins and Alan Ledis (“the Debtor”) moved for summary judgment, and the Court set the matter for hearing on the cross-motions and, in the alternative, to take evidence.
