This action is to recover $1,000, which it is alleged the defendant agreed to pay to the plaintiff as a commission for his services as broker in using his best endeavors to procure and procuring a proper person to purchase the land described, with interest thereon from October *218, 1892. On the day and year last mentioned the plaintiff did procure one Edwin H. Abbot to purchase of the defendant the land, according to the terms and conditions-agreed to by and between the defendant and the plaintiff, to the effect that the property should be sold for $50,000, of' which $5,000 was to be cash and…
