The parties will be referred to as same appeared in the trial court. The plaintiffs sued on a promissory note in the amount of $1,000, executed by the defendants to-the plaintiffs on July 7, 1930, due November 7, 1930, and bearing interest at 10 per cent, per annum from September 1, 1930. The defendants in answering admitted the execution of the note, and as a defense against its payment alleged, in substance, that the said note was executed as a part of the consideration to be .paid by the defendant Cecil C.
