Plaintiff Roger Woods appeals from the trial court’s grant of summary judgment to defendant City of Wilmington on plaintiffs claims for violation of the North Carolina Constitution.

On 11 August 1986 plaintiff was hired by defendant as Survey Party Chief in the City Engineering Department. Plaintiff was subsequently promoted to the position of Engineer I. In at least three separate performance reviews — 15 June 1990, 13 December 1990, and 24 June 1991 — Hugh Caldwell, Jr., (Caldwell) plaintiffs supervisor, rated plaintiffs job performance as “above expected.” The…
