MEMORANDUM DECISION AND ORDER
WINDER, District Judge.
This matter is before the court on defendant’s motion to dismiss plaintiff’s corn- plaint as untimely. 1 The court held a hearing on this matter on January 6, 1989. Plaintiff, Ciaron D. Bailey, was represented by Cheryl M. Brower. Defendant Brown-Foutz Company was represented by Mark R. Madsen. Prior to the hearing, the court had reviewed carefully the defendant’s memorandum.
