Defendant in this divorce action is a highly successful and well-compensated account executive and financial advisor with Morgan Stanley Dean Witter. This court is presented with a unique question raised by defendant in the context of a motion for partial summary judgment. As stated in defendant’s order to show cause, he seeks an order determining as a matter of law that “the clients serviced by the defendant at Morgan Stanley Dean Witter do not constitute ‘his book of business’, which is a marital asset subject to valuation and distribution.” Ac*771cordingly,…
