On January 8, 1929, Albert Peters executed an oil and gas mining lease of five and one-half acres of land owned by him in the county of Muskegon to Harvey I. Nedeau, “trustee for the Beaver Oil Company.” On January 17th following, an agreement and declaration of trust was entered into between Nedeau, Hans Johnson, and Edward Hesse, as trustees, the then holders of the lease, and E. K. Chamberlin and a large number of other persons named therein as beneficiaries, to whom certificates of beneficial interest were issued, for the purpose of developing the above and other land for oil and gas.
