Kendall, Dennis, Jerry and Loyal Dodson (Dodson children) appeal the district court’s grant of summary judgment in favor of J.C. Penney Life Insurance Company (J.C. Penney Life) dismissing their claim for life insurance proceeds following the deaths of their parents, J.B. and Viola Dodson (Dodsons). On November 6, 2002, we filed an opinion reversing the district court’s grant of summary judgment.
