MEMORANDUM AND ORDER

MENTZ, District Judge.

Two motions are now before the Court in this case. Argument on both was heard on September 18, 1982. The first motion was submitted by Citizens and Southern International Bank of New Orleans (“C & S”), pursuant to Rule 65.1 of the Federal Rules of Civil Procedure. 1 C & S’ motion requests the Court to assess damages against Capp-aert Enterprises (“Cappaert”) and Capp-aert’s surety, American Employers Insurance Company (“AEIC”), for wrongful issuance of a temporary restraining order, a preliminary injunction, and an injunction pending appeal.
