The Plaintiffs, Demos Revelis (“Revel-is”) and Marcel Maas (“Maas”) (collectively, the “Plaintiffs”), are a same-sex couple who married in Iowa. They seek to challenge the constitutionality of Section 3 of the Defense of Marriage Act (the “DOMA”), 1 U.S.C. § 7. Defendants, Secretary of the Department of Homeland Security Janet Napolitano and Attorney General Eric Holder (collectively, the “Defendants”) move to dismiss pursuant to Fed. R. Civ.
