WOOLSEY, District Judge.

My judgment is for the defendant herein, and it may have a decree dismissing the complaint, with full costs which will include all taxable disbursements, but will not include any attorney’s fee.

I. My subject matter jurisdiction is based on the Copyright Act, 17 U.S.C.A. § 1 et seq.

II. In view of the decision of the United States Supreme Court on April 25, 1938, in Interstate Circuit, Inc., et al. v. United States, 304 U.S. 55, 56, 57, 58 S.Ct. 768, 82 L.Ed. 1146, it is now a work of supererogation to write a considered opinion on the facts in an equity cause, for its…
