BRICE, Justice.
This action was brought to recover damages for the negligent killing of plaintiffs intestate. Certain of the facts, which are taken from the uncontested findings of the court, are as follows:
On the morning of the 8th day of October, 1932, at a few minutes before 8 o’clock, the deceased, Claire Frank, a young man twenty-one years of age, and his brother, Austin Frank, nineteen years of age, were riding a motorcycle, going east on Central avenue in the city of Albuquerque, up a 3% per cent, grade, at áspeed in excess of twenty, but less than twenty-five miles an hour.
