Pending before the Court is the motion for preliminary injunction of Plaintiff Sanofi-Aventis U.S. LLC (“Sanofi”). Plaintiff, manufacturer of the leading and widely prescribed anticoagulant Lovenox, seeks an Order directing the Food and Drug Administration (“FDA”) to withdraw its approval of an abbreviated new drug application (“ANDA”) submitted by Sandoz Inc.
