The plaintiff filed its Complaint in this case on July 8, 2010, alleging that certain actions taken by the United States Food and Drug Administration (the “FDA”) violated both the Administrative Procedure Act (“APA”), 5 U.S.C. § 702 (2006), and the Food, Drug, and Cosmetic Act (“FDCA”), 21 U.S.C. § 355(a) (2006). This case is now before the Court on the parties’ cross-motions for summary judgment.
