MEMORANDUM
CATHERINE C. BLAKE, District Judge.
Now pending before the court is defendant Express Marine, Inc.’s motion for summary judgment. Plaintiff Charles Dise brought suit against Express Marine, Inc. (“EMI”) under the Jones Act, 46 U.S.C. § 30104, seeking damages for injuries suffered while employed by EMI. EMI subsequently filed various counterclaims against Dise and following this court’s September 4, 2009 Order, EMI’s claim for damages to a skiff remains the sole surviving claim in this lawsuit.
