The City of Miami maintains and operates a jail for the incarceration of prisoners who have been convicted of offenses against the ordinances of the city. In this case the City of Miami was sued by one Pat Lewis, a minor, who alleged in his declaration that the municipality aforesaid knowingly failed to segregate from among pris oners whom it confined within its said city jail, one of its prisoners who was known to be then and there infected with a vile and loathsome venereal disease, as a direct and proximate result of which alleged breach of legal duty on the defendant municipality’s part,…
