In this action the plaintiff partnership and the individual members thereof are seeking the return of the price of $1,500 paid by them to Benjamin J. Stephens, deceased, for the purchase of a certain tract of ground, under the contention that the decedent, who was plaintiffs' vendor, and who received the purchase price, had no title to said property at the time of the purported conveyance thereof.
