PoEEENBARGER, JUDGE:

Deeming itself not liable for the injury complained of in the declaration filed in this case, the defendant demurred to the declaration, and the court below, having overruled the demurrer, has certified its decision thereon to this court for review.

The purpose of the action is recovery of damages for an injury to the plaintiff’s automobile, by a collision with one of the defendant’s motor trucks, on a highway, which, the declaration alleges, was occasioned by the negligence' of the defendant, its -agents and employees, in the driving and management of the motor truck.
