By Act No. 158 of 1949, 1 the Arkansas Legislature empowered the Capitol Grounds Commission (hereinafter called “Commission”), to acquire, either by negotiated purchase or eminent domain, certain parcels of land near the State Capitol building. One of these parcels is here involved: it was owned by appellees, Martin and Kirby, and leased by them to appellant) Capitol Monument Company, for a place of business.
