The defendant stands convicted of murder in the first degree. The evidence on which his conviction rested was purely circumstantial, a matter of no significance, if it carried conviction to the minds of the jury of the defendant’s guilt beyond reasonable doubt. This is all that is required of any evidence, whether direct or circumstantial. And yet, in view of what we shall have to say as to the instructions given by the court to the jury, it has a distinct place in the discussion. The evidence discloses these facts.
