¶ 1. This case comes before us on certification from the court of appeals pursuant to Wis. Stat. § 809.61 (2001-02).1 Yvette Maurin, individually and in her capacity as personal representative of her daughter's estate, and Joseph Maurin, in his individual capacity, brought this lawsuit to re*36cover for medical malpractice and wrongful death of their five-year-old daughter, Shay Maurin.
