Respondent’s motion to dismiss the appeal herein is before this court upon hearing granted after decision by the District Court of Appeal, First Appellate District, Division One. The motion is made upon the ground that the notice of appeal was filed too late. Appellant counters with the claim that the particular circumstances shown by the record in this case are such as to preclude dismissal of his appeal. We are of the opinion that appellant’s position is well taken.
