This matter is before the Court on post-trial motions following a jury trial before this Court. In this case, S.C. Johnson & Son, Inc. (“SCJ”), the designated Plaintiff, asserted claims against Buzz Off Insect Shield, LLC and International Garment Technologies, LLC (collectively, “BOIS”) for (1) trademark infringement under the Lanham Act, 15 U.S.C. §§ 1114(a), 1125(a); (2) false advertising under § 43(a) of the Lanham Act, 15 U.S.C. § 1125(a); and (3) unfair and deceptive trade practices under state law.
