This contract case was referred under former Buie 45(a) (now Buie 57(a)) to Trial Commissioner Mastín G. White with directions to make findings of fact and a recommendation for a conclusion of law. The Commissioner has done so in an opinion and findings filed on January 16, 1964, which deal with one of the claims but not with the entire case. Plaintiffs except to part of the Commissioner’s report (relating to his determination of damages) and the defendant rejects the whole report.
