The question in this case is whether an assignment of a contract for deed, executed and delivered by the plaintiff, Dan. Kolb, to Ms father, the defendant Karl Kolb, was executed as an outright, assignment or' to secure the payment of a debt.
Following a “talk” with his father in the fall of 1941, Dan Kolb made a written offer to the Federal Land Bank to purchase a half section of land in Stutsman County, known as the Dolliver farm.
