This is an action to recover damages to plaintiff’s automobile resulting from a collision with another automobile driven by the defendant Ervin Schatz on the streets of the city of Bismarck about midnight of October 6, 1944. The defendant, Gottlieb Schatz, who was not present at the time of the accident owned the car that was being,driven by his son Ervin, then about twenty-eight years of age.
