ANDREWS, Presiding Judge.

Randy Piper appeals from the trial court’s order denying his plea in bar in which he contended that the State was prosecuting him out of spite and vindictiveness. For the following reasons, we affirm.

The record shows that Piper was charged on December 8, 2008 with possession of methamphetamine and possession of a drug-related object (Case No. 08-CR-1027-J). On February 16, 2009, Piper was indicted for theft by conversion, theft by receiving, and theft by taking (Case No. 09-CR-086-A).
