This is an appeal hy defendant from a judgment awarding plaintiff damages for injuries sustained from falling down a stairway in defendant’s apartment house in Portland, Oregon. Defendant assigned as error (1) denial of her motion for non-suit, and (2) denial of her motion for a directed verdict. Both involve substantially the same legal questions and, therefore, will be treated together.
