OPINION

GREENWOOD, Judge:

T1 Tom Ramsey (Plaintiff) appeals the trial court's grant of First Security Bank's (First Security) Motion to Dismiss under Utah Rule of Civil Procedure 12(b)(6). We affirm.

BACKGROUND 1

1 2 Plaintiff sold livestock through the Ogden Livestock Auction (the Auction) in Farr West, Utah, from approximately January 1, 1997 through October 1, 1997.
