Appeal from a judgment of the Supreme Court (Lamont, J.), rendered September 20, 2001 in Albany County, convicting defendant upon his plea of guilty of the crime of burglary in the third degree.

In satisfaction of an 11-count indictment, defendant pleaded guilty to the crime of burglary in the third degree. As part of the negotiated plea agreement, he was to receive a sentence of 3Vs to 7 years in prison as a second felony offender. Subsequently, defendant was sentenced, as a second felony offender, to 3 to 6 years in prison and now appeals.
