MEMORANDUM OF DECISION AND JUDGMENT

ESCHBACH, Chief Judge.

This action was brought by the Government to recover statutory penalties for alleged violations by the defendant of the Hours of Service Act, 45 U.S.C.A. §§ 61-64, in keeping railroad employees on duty in excess of the statutory maximum hours. The court granted motions to intervene as plaintiffs filed by the United Transportation Union and the Brotherhood of Locomotive Engineers. This cause is now before the court on cross-motions for summary judgment, accompanied by stipulations of fact signed by all the parties. For the reasons set…
