In this cause appellant, Dazaro Garza Ayala Benavides, brought an action in the form of trespass to try title against ap-pellee, S. E. Garcia, to recover title and possession to lot 8, block 92, Western addition to the city of Daredo. Garcia answered by plea of not guilty.
