KINNEARY, Senior District Judge.

This matter comes before the Court to consider the motion of the Plaintiff for a preliminary injunction, Fed.R.Civ.P. 65(a), and the motion of the Defendant to dismiss, Fed.R.Civ.P. 12(b)(6).

FACTUAL BACKGROUND
