This is a suit in the ordinary form of trespass to try title, brought by the appellants on the 12th day of July, 1890, in the District Court of Edwards County, to recover from the appellee John M. Piper three tracts of land situated in said county, which are described as follows, viz.: One-third of a league of land, patented to the heirs of Elijah B. Franklin on the 3rd day of July, 1847, patent number 458, volume 5; 640 acres of land, patented to the heirs of Elijah B.
