Mrs. C. B. Miller and her husband, T. K. Miller, brought this action of trespass to try title against the appellants to recover an undivided half interest in twelve hundred and eighty acres of land, part of a nineteen hundred and twenty acre tract granted as bounty to the heirs of Orlando Wheeler, who fell at Goliad in the Fannin massacre. Orlando Wheeler at his death was a single man, and left no heirs in either the descending or ascending line. He left, however, collateral relatives as follows: Two brothers, Olin H.
