MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Plaintiffs Sara Russo, David Russo and Mary Ann Parker have sued defendant Bache Halsey Stuart Shields, Inc. (“Bache”) for securities fraud under Section 10(b) of the Securities Exchange Act of 1934, 15 U.S.C. § 783(b), 1 Rule 10(b)5, 17 C.F.R. § 240.10b-5, 2 several rules of the Chicago Board of Options Exchange, 3 Section 5(b) of the Securities Act of 1933, 15 U.S.C. § 77e(b)(2), 4 Regulation T of the Federal Reserve Board, 12 C.F.R. § 220.4(e)(2), 5 as well as various state law claims.
