Plaintiff: began an action to quiet title to certain quartz mining property situated in the county of Tuolumne, state of California. The title to these premises was formerly in the Santa Ana Mining Company, a corporation. The appellant bases his claim to the property in question by virtué of the locations made thereof on January 1, 1917. Respondent claims said property by virtue of a subsequent location made thereon by him on April 10, 1920.
