His Honor Judge Frank McGloin

delivered the opinion and decree of the Court in the words and figures following, to wit;

Plaintiff sues Henry Ballard as principal and Joseph Reider as surety upon a contract of lease for a balance of rent. The defendant Reider pleads the general issues, accompanied by a special denial of the genuineness of his signature to the lease sued upon. The case was twice examined before the lower Court, the second time being in pursuance of a new trial granted to Reider alone, the judgment becoming final as to Ballard.
