RIPPLE, Circuit Judge.

David Johnson was charged in an indictment with possession of two unregistered firearms in violation of 26 U.S.C. § 5861(d) and with unlawfully manufacturing two firearms in violation of 26 U.S.C. §§ 5822 and 5861(f). The jury returned a verdict of guilty on the possession charge but was unable to reach a verdict with respect to the manufacturing charge. A judgment of conviction on the possession charge was entered by the district court on April 17, 1997, and Mr. Johnson was sentenced to thirty months in prison. He now appeals.
