WILLIAMS, J.

Plaintiff below, David D. Trumbull, filed his petition against the defendants Maud N. Stentz, Homer Fletcher, Frances N. Fletcher and The Citizens Banking Company of San-dusky, Ohio. The plaintiff sought to have title to certain property described in the petition quieted and partition thereof made. The defendants, Homer Fletcher and Frances H. Fletcher, demurred to the petition upon the ground that it did not state facts sufficient to constitute a cause of action.
