This cause came on to be heard upon the petition for the construction of the last will and testament and codicil of Benjamin F. Kiester, Sr., deceased, a former resident of the City of Dayton, County of Montgomery and State of Ohio, who died August 21st, 1922, leaving surviving *456him his widow, Lula Kiester, and one son, Benjamin Franklin Kieste hereinafter referred to as Benjamin F.
