This was an action of covenant brought by Levi Woodruff against Stratton Sisk. The declaration alleged in substance, that the defendant, on the 13th of September, 1830, for the consideration of one hundred dollars, sold and conveyed a certain tract of land, situated in Hopkins county, Kentucky, to Robert Woodruff, his heirs and assigns, by deed of general warranty; that on the 29th of August, 1832, Robert Woodraff sold and conveyed the same tract of land to the plaintiff, his heirs and assigns, by deed of general warranty, and that the plaintiff thereupon took possession of the same; and that…
