Appeal by the Board of Inspectors of Election in the First Election District of the Second Ward of the City of Mount Yernon, and another, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Westchester on the 29th day of November, 1901, directing the inspectors of election in the first district of the second ward of the city of Mount Yernon to reconvene and make a second canvass of the votes cast in the said district on November 5, 1901, for mayor of that city.

Jenks, J.:
This application was made against the board of inspectors, the county clerk and the city clerk. None of the other election officials was included. The relator’s affidavit stated that the certified statements of the canvass do not agree with the tally sheets or with the ballot clerk’s return sheet, the said return sheet does not agree with the tally sheets or with the certified statements, and certain excerpts are stated to show irregularities and lack of harmony therein, and to show other defects and irregularities.
