This opinion concerns the applicability of Soucy v. Soucy Motors, Inc., 143 Vt. 615, 471 A.2d 224 (1983), to cases tried prior to Soucy. We hold that Soucy applies prospectively only, and therefore strike our order remanding this case for a new trial.
The procedural history of this case is as follows. The plaintiffs filed a complaint in superior court against the defendants, alleging breach of fiduciary duty and fraud.
