REED, Judge:

We have examined the record of trial, the assignments of error,1 and the Government’s reply thereto.2

Appellant was tried on 20 March 1991 by a special court-martial, military judge alone. Pursuant to his pleas, he was convicted of one specification of resisting apprehension (Charge I), one specification of assault (Charge II), and one specification of carrying a concealed weapon (Charge III), in violation of the Uniform Code of Military Justice (UCMJ), Articles 95, 128, and 134, 10 U.S.C. §§ 895, 928, and 934, respectively.
