Kristie Urban was granted a personal recognizance (PR) bond subject to the condition that she go to the Johnson County Community Corrections Residential Center. After she failed to return to the facility while on a pass to visit her family, the State charged her with aggravated escape from custody. The district court dismissed the charge because it believed Urban’s PR bond and placement at the facility did not fit the definition of custody under K.S.A. 21-3809(b)(1).
