MEMORANDUM OPINION AND ORDER
THIS MATTER is before the Court on motion of the defendants Insurance Company of North America (hereafter “INA”) and The Home Insurance Company (hereafter “Home”) for judgment on the pleadings pursuant to Fed. R. Civ. P. 12(c). The dispositive issue raised by the motion is whether this Court has subject matter jurisdiction in a declaratory judgment action to adjudicate the rights, responsibilities, and priorities of the potential excess insurance carriers in an underlying tort action.
